Optimumfusion (“Optimumfusion,” “we,” “us,” or “our”) is a full-service digital agency based in Newton, Massachusetts, United States. We provide digital services through our website at optimum-fusion.com (the “Site”) and in the course of delivering services to our clients. This Privacy Policy explains what personal information we collect, how we use and share it, and the choices and rights you have. For visitors from the European Economic Area (EEA), United Kingdom, or Switzerland, Optimumfusion is the “data controller” of personal information collected through the Site.
By using the Site or engaging our services, you agree to the practices described in this Policy. If you do not agree, please do not use the Site.
1. Information We Collect
Information you provide to us
- Contact form. When you contact us through the form on our Contact page, we collect the details you enter, such as your name, email address, phone number, company name, the service you are interested in, and your message.
- Chat. If you use the chat window on the Site, we collect the messages you send and any contact details you choose to share.
- Booking a call. When you book a strategy call through our online calendar, we collect your name, email address, phone number, the time you choose, and any notes you add.
- Business communications. Information you share with us by email, phone, or during meetings, proposals, and engagements.
Information collected automatically
- Technical data. When you visit the Site, our hosting provider and the third-party services described in Section 4 automatically receive technical information such as your IP address, browser type, device type, operating system, referring page, and the date and time of your visit. This happens as part of delivering web pages, fonts, and embedded tools to your browser.
- Cookies and similar technologies. The Site uses Google Analytics to understand how visitors use it, which sets analytics cookies. It does not set advertising cookies. The embedded form, chat, and booking tools may also set cookies or use similar browser storage. See Section 4.
Information we process on behalf of clients
In delivering our services, we may process personal information contained in materials, systems, or data our clients provide to us (“Client Data”). We process Client Data under the instructions of the relevant client and the terms of our service agreements. The client remains responsible for that data; if you have questions about how a client of ours handles your information, please contact that organization directly.
2. How We Use Your Information
- To respond to inquiries, chat messages, and booking requests, and to provide requested information or proposals;
- To schedule and hold strategy calls and send related confirmations and reminders;
- To deliver, manage, and improve our services;
- To operate, maintain, and secure the Site;
- To comply with legal obligations and enforce our agreements;
- To protect the rights, safety, and property of Optimumfusion, our clients, and others.
We do not send newsletters or marketing emails from the Site. If you contact us, we may follow up about your inquiry by email, phone, or text message.

3. How We Share Information
We do not sell personal information, and we do not “share” it for cross-context behavioral advertising as those terms are defined under the California Consumer Privacy Act (CCPA). We have not sold or shared personal information in the preceding 12 months, and we do not knowingly sell or share the personal information of anyone under 16. We disclose personal information only in the following circumstances:
- Service providers. With vendors that help us run our business, such as website hosting, our CRM and its form, chat, and booking tools (see Section 4), email, and cloud storage, under terms that limit their use of your information.
- Professional advisers. With lawyers, accountants, and insurers where necessary.
- Legal requirements. Where required by law, regulation, legal process, or governmental request, or to protect our rights or the safety of others.
- Business transfers. In connection with a merger, acquisition, financing, or sale of all or part of our business.
4. Third-Party Tools and Cookies
The Site does not use advertising trackers. It does load the following third-party services, which receive information directly from your browser:

| Google Analytics | We use Google Analytics 4 to see which pages are visited, how visitors arrive at the Site, and roughly where they are located. It sets first-party cookies and sends Google your IP address, browser details and the pages you view. Google Analytics 4 does not log or store IP addresses, and we have turned off Google signals and ad personalization. If your browser sends a Global Privacy Control signal, Google Analytics does not load. You can also opt out with the Google Analytics opt-out browser add-on. |

These providers process information under their own privacy policies. You can block or delete cookies through your browser settings; if you block them, the form, chat, or booking tools may not work as expected. Blocking cookies does not affect how the Site works if you only browse it.
Global Privacy Control. We recognize opt-out preference signals such as Global Privacy Control (GPC). Because we do not sell or share personal information, no further action is needed, but we treat a GPC signal as a valid opt-out request for that browser.
5. Data Retention
We keep personal information only as long as needed for the purposes described in this Policy, for example, for as long as needed to respond to your inquiry, for the duration of a client engagement, and for any period required for legal, accounting, or record-keeping purposes. When information is no longer needed, we delete or anonymize it.
6. Data Security
We use reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, loss, misuse, or alteration. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.
7. International Transfers
We are based in the United States, and information collected through the Site is processed and stored in the United States and other countries where our service providers operate. These countries may have data protection laws that differ from those in your country. Where we transfer personal information from the EEA, UK, or Switzerland, we rely on appropriate safeguards recognized under applicable law, such as the European Commission’s Standard Contractual Clauses (and the UK Addendum or International Data Transfer Agreement) offered by our service providers, or transfers to recipients certified under the EU-U.S. Data Privacy Framework. You may contact us for more information about the safeguards used.
8. Your Rights and Choices
All visitors
You can ask us to stop contacting you at any time, control cookies as described in Section 4, and contact us with questions about your information.
EEA, UK, and Swiss residents (GDPR)
You have the right to: access a copy of your personal data; rectify inaccurate or incomplete data; erasure (“right to be forgotten”); restrict processing; object to processing based on legitimate interests, including direct marketing; data portability; and withdraw consent at any time without affecting prior processing. You also have the right to lodge a complaint with your local supervisory authority (a list is available at edpb.europa.eu; in the UK, the Information Commissioner’s Office). We will respond to requests within one month.
US state residents
Residents of California and other states with comprehensive privacy laws (including Colorado, Connecticut, Virginia, Texas, Oregon, and others) may have the right to: know and access the personal information we have collected about you; correct inaccurate information; delete your information; obtain a portable copy; opt out of the sale or sharing of personal information and of targeted advertising (we do not sell or share personal information or engage in targeted advertising); limit the use of sensitive personal information (we do not use sensitive personal information beyond permitted purposes); and not receive discriminatory treatment for exercising your rights.
California residents: in the preceding 12 months we have collected the categories of personal information described in Section 1 (identifiers, commercial information, and internet activity), for the purposes in Section 2, and disclosed them for business purposes to the service providers in Sections 3 and 4. You may designate an authorized agent to submit requests on your behalf.
Appeals. If we decline a request, you may appeal by replying to our decision or contacting us with “Privacy Appeal” in the subject line. If your appeal is denied, you may contact your state Attorney General.
Exercising your rights
To exercise any of these rights, contact us using the details in Section 12. We may need to verify your identity before responding, and we will respond within the timeframe required by applicable law (generally 30 to 45 days). Exercising your rights is free of charge.
9. Third-Party Links
The Site may link to third-party websites or services, such as our social media pages. This Policy does not apply to those sites, and we are not responsible for their privacy practices. We encourage you to review their privacy policies.
10. Children’s Privacy
Our Site and services are intended for businesses and professionals and are not directed to children under 16. We do not knowingly collect personal information from children under 16, and we do not sell or share the personal information of minors. If you believe a child has provided us with personal information, please contact us and we will delete it.
11. Changes to This Policy
We review this Privacy Policy at least once every 12 months and may update it from time to time. When we do, we will revise the “Last updated” date above and, for material changes, provide additional notice on the Site. Your continued use of the Site after changes take effect means you accept the updated Policy.
